Hey guys (and any cool girls who visit the board),

Sorry for the irregular visits to the board,

I turn to all of you for advice and opinions, just to make sure that I have looked at this situation from every angle.

For now I will not mention the name of the seller out of respect.

Here is my situation:

I purchased a set of 968 Calipers a few months back and the total came to $620. Then after a few weeks of receiving nothing in the mail I decided to email the seller to find out what has happened.. only then am I informed that he is having paypal problems and his account is blocked.

I apply for a refund and paypal only managed to retreive $361.01 as that was all that was left in the account (this is all in the paypal log)

Now i have been in contact with the seller (who is still running business as usual and selling porsche items regurally) and started by nicely asking for the remainder of my cash back, after he refused, i decided to settle this in a nicer way and just asked for a few parts that are worth less than what he owes me.. yet again he refused and reason being and i quote:

"Your idea of fairness is anything but fair. There is nothing to settle between you an I."

My fair idea was the one mentioned above of sending me some parts instead of the rest of my cash back.

Am I right in beleiving that it is not my problem at all wether he has problems with his paypal account or not, when he did state that he does accept paypal on the auction? He could have easily asked for a credit card payment (thank god i did not trust him with my credit card number!)

I will happily post all the emails and logs inc auction details on a website so everyone can see the whole situation as I have nothing at all to hide.

Please let me know your views!

Mainly i have been in contact with paypal, who still are working on the case to get the rest of my cash back, but are having problems retrieving the rest of my $ due to lack of funds in his account..

I am confident I am in the right on this one, just want to be sure.. opinions in both favours appriciated..

Sounds like a thief to me. You should post his EBay name as a warning so other folks don't get screwed. Here is how a transaction should go:

1. Buyer pays money immediately upon agreeing to purchase
2. Seller ships what has been paid for immediately upon receipt of payment

That's it, pretty simple. If it doesn't work that way, someone is being screwed. It's my opinion that an EBay or private seller doesn't get anymore leeway than a "regular" business. If they are willing to take money for goods, they are a business plain and simple.

if you payed with paypal and used a credit card, then you should contact your credit card and have them issue a chargeback immediately!

Hey Guys,

Unfortunately Lizard I payed him with funds that were in my paypal account and they have done all they could to get my cash back but only managed a partial refund,

I can take legal action through the american embassy over here but did not want it to result into something like that if it was avoidable.

His details are:

Name: David Mandache
Company Name: Northeast Auto Inc.
Ebay ID: xdavids

I know some other board members had problems with him in the past, did they all manage to resolve the problem?

Anyone have any other experiences with him that they would like to share?

Also to the best of my knowledge he is on this board too..

I don't see how you could be anything in the wrong? I mean you paid a lot of money for parts, and didn't get any parts. This guy owes you 600+ dollars!

Lessons learned:

1. Never ever ever pay for anything online with anything other than a credit card
2. Never ever wait more than 1 month to file a complaint if you don't get the goods your ordered

Ask me how I know.

Hey all, thanks for all the support!

Exactly what i thought and knew all along.. this guy is a scam artist!

Learnt the lesson and will always pay via credit card from now onwards..

Do you think it will still be a problem to file a complaint through ebay considering this happened about 4 months ago now?

If i was there i would definately pay him a visit.. unfortunately the 5000 miles distance doesnt help

For some good news that will hopefully cheer alot of people up:
My latest update in getting my cash back..

I was in contact with the american embassy over here who will tomorrow give me more information on a dept. in his area that will deal with him accordingly, the good news is, if he is found to be a fraud (which he will with all the evidence against him) he should not be in business for much longer! They also seemed concerned that a USA citizen gives US trade a bad name..

I hope you are reading this David Mandache and the post has made your day as much as it has made mine!

To everyone else over here.. you rule!
Thanks a million to everyone.. feel free to continue posting.. i will keep everyone updated on the progress with this jerk..

On a better note, im not sure which of you guys remember but i was in the process of customizing my 924.. well on thursday at 1.45pm it will be on the tow truck back to my garage were i will shoot some pics.. still has alot of work to be done but the body work and paint job looks sound..

Have some pics if you guys want of it before it was sprayed.. they dont do it any justice but gives you a good idea..
